The public comment period for USCIS’ proposed fee increase they ended on March 13, 2023, with more than 6,000 comments. The fee increases will not go into effect until the final rule is published.
What’s happening?
USCIS released a proposal in January that would raise application fees for almost every immigrant category to the US, including a doubling of total expenses for marriage-based green card applications and a doubling of fees for accompanying children. For an immigrant family of four, the costs could exceed $10,000. Other immigration applications are also set to increase in prices, such as fiancé visa petitions, relative petitions, and removal of conditions applications.
Why is this happening?
USCIS is proposing fee hikes to improve customer service operations and manage the incoming workload due to staffing challenges and an ever-increasing application backlog.
When will these changes take effect?
USCIS is required to follow a process to enact major changes to its services and fee schedule, which includes publishing a proposed final rule and conducting a 60-day comment period. If the final rule mirrors the recommended fee increases, new fees could take effect as soon as May 2023.
