USCIS to Increase Premium Processing Fees Starting March 1, 2026

The U.S. immigration landscape will see an important update in 2026. According to an official announcement from U.S. Citizenship and Immigration Services (USCIS), Premium Processing fees will increase for several immigration benefit categories, effective March 1, 2026.

This change applies exclusively to Premium Processing requests filed with Form I-907 and reflects USCIS’s regular fee adjustments to account for inflation and operational costs.

What Is Premium Processing?

Premium Processing is an optional USCIS service that allows petitioners to request expedited adjudication of certain immigration benefits. When available, USCIS commits to processing the request within a guaranteed timeframe, offering faster decision-making for employers and applicants.

Updated Premium Processing Fees (Effective March 1, 2026)

USCIS has confirmed the following new Premium Processing fee structure:

  • Form I-129 (most classifications): $2,965 (previously $2,805)

  • Form I-129 (H-2B and R-1): $1,780 (previously $1,685)

  • Form I-140 (Immigrant Worker Petition): $2,965 (previously $2,805)

  • Form I-539 (F, J, M status extension or change): $2,075 (previously $1,965)

  • Form I-765 (eligible EAD categories, including OPT and STEM OPT): $1,780 (previously $1,685)

These updated fees apply to requests postmarked on or after March 1, 2026.

Why Is USCIS Increasing Premium Processing Fees?

USCIS states that Premium Processing fees are adjusted periodically to maintain the real dollar value of the service, fund operational improvements, and support adjudication efficiency. Importantly, these fee changes do not affect standard processing fees—only Premium Processing requests.

What Applicants and Employers Should Know

  • Submitting an incorrect Premium Processing fee may result in rejection or return of the filing.

  • Petitioners planning time-sensitive filings should review timelines carefully before March 1, 2026.

  • Premium Processing remains optional and availability depends on the specific benefit type.
